Deep Dive
Indiana has enacted House Bill 1042, signed into law by Governor Mike Braun, which will allow certain retirement and savings plans to include cryptocurrency investments and establishes stronger legal protections for the crypto industry.
The new legislation mandates that Indiana's state public retirement and savings plans must offer self-brokerage accounts with at least one cryptocurrency investment option by July 2027. This requirement specifically applies to the legislators' defined contribution plan, the Hoosier START plan, certain public employees' retirement funds, and designated teachers' retirement fund plans.
House Bill 1042 also includes provisions to safeguard the rights of cryptocurrency users. Public agencies, with the exception of the Department of Financial Institutions, are prohibited from implementing rules that ban crypto payments, self-custody, or mining. Additionally, the bill clarifies that money transmitter licenses are not required for applications and software protocols facilitating non-custodial transfers.
Local governments, including counties, municipalities, and townships, are also restricted from imposing special regulations on crypto mining businesses or home miners that are not applied to similar businesses or activities within the same zoning area. This measure addresses potential conflicts arising from issues like noise complaints associated with crypto mining operations, which have been a point of contention in other states.
The move by Indiana aligns with a growing trend of institutional adoption of digital assets. Bitbo estimates that companies, ETFs, and governments collectively hold over 3.7 million Bitcoin, valued at $258 billion. At the federal level, President Donald Trump's executive order in August aimed to democratize access to alternative assets like crypto within 401(k) plans. Analysts predict that even a small allocation to crypto in 401(k)s could lead to significant new investment flows into the market.
